FISH MOBILE DISCOS – full TERMS AND CONDITIONS
1. Definitions
In these Terms and Conditions, the person, firm or company making the booking is referred to as “the Client”, and Fish Mobile Discos is referred to as “the Discotheque.”
2. Agreement
This agreement is made between the Client and the Discotheque. By returning a completed Booking Form or otherwise confirming a booking, the Client agrees to be bound by these Terms and Conditions.
A booking shall only be considered confirmed once the Discotheque has received the completed Booking Form and the required deposit (or full payment where applicable), and has issued written confirmation.
3. Engagement
The Client engages the Discotheque to provide a Disc Jockey and associated equipment at the agreed venue, date, times and fee. The Discotheque agrees to fulfil this engagement subject to these Terms and Conditions.
4. Booking Fee and Deposit
A non-refundable booking reservation fee (“deposit”) is required to secure the booking unless otherwise agreed in writing.
5. Payment
5.1 The balance of the booking fee must be paid either:
• by BACS prior to the event; or
• in cash on or before the event (if agreed in advance)
5.2 The Discotheque reserves the right to refuse to perform if full payment has not been received.
6. Performance Duration
The agreed fee covers performance during the specified times only. Any extension must be agreed and paid for accordingly.
7. Cancellation by the Client
7.1 Cancellation must be made in writing.
7.2 Where cancellation is made more than one calendar month before the event date, the deposit will be retained (or 25% of the booking fee where no deposit has been paid).
7.3 Where cancellation is made within one calendar month of the event date, the full booking fee shall become payable.
8. Cancellation by the Discotheque
8.1 The Discotheque may cancel this agreement without liability in the event of circumstances beyond its control, including but not limited to illness, accident, equipment failure, theft, or vehicle breakdown.
8.2 The Discotheque will use reasonable endeavours to provide a suitable replacement Disc Jockey.
8.3 In the event that performance cannot be fulfilled, all monies paid will be refunded. This shall be the limit of liability.
9. Venue, Safety and Working Conditions
9.1 The Client must ensure that the Disc Jockey has access to two 13 amp 240 volt sockets and a safe, suitable working area. The working position must not obstruct any emergency exit and must allow sufficient space for safe operation.
9.2 The Client must ensure that all guests and attendees maintain a safe distance from the Disc Jockey and equipment at all times, including during setup and takedown periods. The working area must remain clear to avoid risk of injury or damage.
9.3 Where equipment is set up prior to the performance and left unattended at the Client’s request, the Client accepts full responsibility for ensuring that no person interferes with or uses the equipment.
9.4 The Client is responsible for the behaviour of all guests and for safeguarding the Disc Jockey and equipment against theft, damage or other risks from arrival until final departure. Any loss or damage (excluding fair wear and tear) will be chargeable.
9.5 The Disc Jockey reserves the right to delay setup, pause performance, or cease performance and/or takedown if the working environment is deemed unsafe. Any delays caused by unsafe conditions may result in a reduced performance time without liability.
10. Delayed Takedown
10.1 The Client must ensure that the Disc Jockey is able to dismantle and remove equipment promptly at the agreed finish time.
10.2 Where takedown is delayed due to the actions of the Client, guests, venue staff, or any third party outside the Discotheque’s control (including but not limited to restricted access, blocked exits, or unsafe conditions), an additional charge of £100 per hour (or part thereof) will be applied.
10.3 This charge reflects additional time, staffing, transport, and associated operational costs incurred.
10.4 The Discotheque reserves the right to invoice such additional charges following the event, and payment will be due within 7 days.
10.5 Where performance or takedown is delayed or prevented due to the behaviour of the Client or guests, no refund shall be payable.
11. Equipment and Performance
11.1 The Discotheque will supply suitable music, sound equipment, and lighting appropriate to the event.
11.2 All equipment is regularly maintained and tested.
12. Equipment Failure
In the unlikely event of a complete sound system failure that cannot be rectified, a pro-rata refund will be issued for the remaining performance time. This shall be the limit of liability.
13. Lighting and Effects
The Discotheque cannot be held responsible for any adverse effects caused by lighting, sound, or special effects. The Client must notify the Disc Jockey in advance of any sensitivities or restrictions.
14. Substitution
The Discotheque reserves the right to provide a suitably qualified replacement Disc Jockey if necessary.
15. Client Responsibilities
The Client is responsible for obtaining any necessary licences and permissions required for the event.
16. Zero-Tolerance Policy
The Discotheque operates a strict zero-tolerance policy towards abusive, threatening, or unsafe behaviour, including interference with equipment.
If the Disc Jockey considers the environment unsafe, performance may be paused or terminated without refund.
17. Children’s Events (where applicable)
17.1 Adequate adult supervision must be provided at all times.
17.2 Supervising adults must assist where required.
17.3 Children must not interfere with equipment.
18. Limitation of Liability
The Discotheque’s liability shall be limited to a reasonable proportion of the booking fee, taking into account work already undertaken, including administration, preparation, travel, setup, and performance.
Under no circumstances shall liability exceed the total booking fee.
19. General
Any breach of these Terms and Conditions may result in the Discotheque refusing to perform or ceasing performance without refund.
